When you give notice at a job, should you be paid for vacation time accrued?

My husband has 3 weeks paid vacation a year. He gave a months notice and worked it out. He has therefore accrued one week of his vacation, and expects to be paid this. His former employer says you only get that if he fired him. Who is correct?|||There's no law protecting "vacation" pay or "sick" pay. Your husband will only be entitled if he has an employment contract that states it is legally his.|||It depends on your contract or company policy. He should discuss this with the HR manager.|||Typically, most companies pay out accrued vacation, wether your fired or your resign. I would check with your state office of employment and find out what the rules are in your state. I think the former company is trying to not pay what they owe.|||Whether or not he gets money for his accrued vacation is entirely the choice of the employer. There is no law stating that accrued vacation must be paid. Your husband is advised to check his employment handbook/manual, if the firm has one. Any policy on such would be stated therein.
