Do salary employees get paid while on vacation since vacation hours are earned?

Lets say for example you earned five days of vacation which totals 800.00


Do you get paid the 800.00 plus the days your not at work because of vacation if your on salary?|||No. You merely get paid the same whether you're on vacation or not. For example, if you're given 5 weeks of vacation, you'd still get the same check ever other week, regardless of whether or not you were on vacation for those two weeks or were in the office working for those two weeks. Instead of being earned like some companies make vacation time, salaried employees are simply given a set amount of vacation time.

I can "roll over" 8 weeks vacation, so if I don't use any vacation this year, I have to take 8 weeks next year! If, however, I use 2 weeks this year I can roll over the other 6, but then I must use 6 next year or else lose it. And, yes, there are many years where I don't use all my vacation.





My company does allow us to turn in unused sick time for pay, so every 18 months I can turn in 20 days of sick time and receive 10 days pay, it's better than just having those unused days. It's a nice "bonus" every year and a half!|||%26lt;~ lab technician

For what it's worth - I don't recommend choosing employment based on paid time off. I would really think twice about hiring someone who seemed more interested in their time off than in what they could contribute to the organization. My two cents.

Question about company paid vacation time?

Can a company force you to take a weeks paid vacation if you have not yet accrued that week, thus becoming indebted to them for the time you have yet to accrue? I say it's against the law. I know it is, but can't find any language to back up my claim. Any suggestions? I can't find it on the U.S. Dept of Labor website.|||I think they can force you to take paid vacation, but if they didn't owe it to you, it is sort of dumb.|||Absolutely not. They can force you to take time accrued. But not time you do not have.

I am not sure the legality of this practice, but my understanding is if you are classified as a full time employee - even in the Emperial Senate - you have to be paid for at least the minimum the company deems full time (if the minimum worked is 35, then they have to pay you for 35 hours - even if you don't have the vacation - if they are the ones responsible for your time off). So I would think that a company could not force you to take a vacation, for they would still legally have to pay you for the time off if you are full time. Or else you can go and collect unemployment for the difference from what you worked to what you are supposed to for full time hours.

From what I understand, if you quit a workplace and have earned time off, you are most likely going to forfeit that time. Certain places will probably pay you for it, but not all places.





Call your human resources department and ask them this question. If they state you will be loosing that time, then use it. I know there are "sick days" but those are always looked down upon and sometimes, HR asks for doctors notes.|||Enlightened companies give their employees a lump set of time called PTO or Paid Time Off. In all the jobs I have had, you would not be paid for unused vacation time is you were fired. Some companies don't allow you to "earn" vacation. They simply just state that after a year, you get two weeks; after 5 years you get 3 weeks, etc.





In those situations, since you aren't earning vacation by working a set number of hours per year, the company may not pay the vacation when you leave. My boyfriend worked at Best Buy for a few months. He took a weeks vacation. He quit the day that he was supposed to come back. In the employee handbook, it states that an employee can quit at any time without any repercussions. He thought that he might have a hard time getting his paid vacation since he quit, but he called corporate office and they said that he was still entitled to it and should check with the store office. He called the store office and the associate said that he would receive a check in the mail. When a week went by and no check came, he called them back and they said that it was no processed and that they would resubmit it and he'd get it in the next cycle's paycheck (which was today). Still no vacation pay. This is getting ridiculous. It's been almost 4 weeks since his vacation and still no vacation pay. What rights does he have in regards to getting his pay? He's already talked to corporate and basically, they said that yes, he's still entitled to it.|||With the cost of legal fees it would be best to wait it out . . Is it legal to take away paid vacation and sick time from full time employees in Illinois? My mom's work just did this to everyone in the company, excluding the heads of the departments so only those select few people will still receive paid time off. It is not a nationwide company, but a lot of people work for it. I don't know if it makes a difference, but she works at a Hotel. Are they allowed to do this? If not, who should she go about contacting?|||It may be ethically unfair but perfectly legal. Can an employer drop paid vacation and sick days?

I am in Washington State. I am aware that providing paid vacation time and sick days are not required by law but I need to know if when you are already provided that benefit can the employer take that benefit away with out prior notice? I have searched the web and have answers for several other states but not my own.|||PTO is a benefit or gift, it can be modified ,given or taken away with or without notice, you are correct that some states regard them as wages earned, however WA is not one of them|||Well, they can take away the sick time without notice. The PTO are considered to be earned benefits and fall under a separate law that requires the employer to provide notice to employees about changes in the accrued benefits. Some States also have laws to protect employees in this area. I would call the Department of Labor in your state and ask the question. Always go to the legal authority in the State in which you live for absolute answers related to accrued benefits.





Is it illegal, maybe, depends on the State in many cases but if I were to guess, I would say that the vacation hours, if earned, fall un ERISA laws and would require notification. The sick hours would not as they are really the "gift" that one of your responders indicated. Those benefits are considered to be "provided benefits" and do not fall under the same Federal laws. Again, check with your State Department of Labor for the real answers.|||Without a union, or a signed employment contract, a corporation in the state of Washington has you 'at will' - which means they can fire you for any reason at all. This means that theoretically, they can take away your benefits without prior notice.





I said theoretically. If the benefits you lost are substantial, it might be worth it to talk to a labor attorney in the state of Washington. Why? The judges in the state are know to be very, very pro-employee. Many of the cases I have read about rule in favor of the employee, citing that the company, being in the dominant position with regards to employment, has a heavier obligation to the employee than the employee does to the company.|||In many states they can't take away vacation that you have already accrued, but they can end the policy with no notice so you don't accrue any more. Most places they can take away sick days even those already accrued.|||Sure they can. You are not a union member so your employer can do whatever.

I get paid for the Christmas break, fall break, spring break and other holidays during the school year, even though I do not work on those days.





Contrary to popular belief, I do *NOT* get paid for the summer, unless I teach summer school. The checks I receive during the summer are for work performed during the 10 month contractually decided school year.





Most (but by no means all) school districts spread out the pay you earn over 10 months over all 12 months, so that you get the same paycheck all 12 months of the school year.





Personal days vary from district to district, also. At the district in which I currently teach, I get 3 personal days but they are not "paid" - in fact, when I use them, I actually have to pay for them. In other districts in which I have worked, my personal days were paid.





Sick leave is paid, and in all districts in which I have worked, it has been 10 days per school year.





If you are considering accepting a teaching position, be sure and ask to see the contract up front and examine it carefully. Ask to speak to a union representative if you have any questions about the contract and how its provisions will apply specifically to you.

|||yes|||yes and no...I get paid for the christmas break and easter break...but I do NOT get paid for the summer. I plan ahead by putting money away during the year. I get 2 personal days per year, those are paid. I also get 3 family days...these are for children that are sick or in my case, when I need to take my parents' to a doctor appt.


So in general, you get a yearly salary that is divided into 22 pays. If a holiday falls during any given week, then you are paid for it through your salary.


And keep in mind that as a teacher, if you want to go away on vacation, you have to go at the busiest times of the year when everyone else goes.|||In my school district we get 7 sick days and 3 personal days. Vacation days are simply the same days that the students get off and yes these are paid.|||NO paid vacation...probably only profession where you work for 30 years without a paid vacation...not paid for spring break or winter break either...sick leave is about one day a month for nine months and personal days means you can use a sick day without using the excuse of sick...personal days come from the same source-sick days. only one personal day a year.|||.no you get paid unemployment and you may qualify for welfare|||In California, teachers do not get any vacation time. If you are not working, you are not paid. Of course, the pay is pretty good for when you are working. But with the workloads (I have 32-35 kids per class in my English classes) I always have to take work home. We also receive 10 days sick leave a year, which can be rolled over. In a way it's a good system and in another way, it's not.





I have informed my students how I get paid (not the dollar amount) so that they understand why I don't have all their essays graded in a week's time.
