Lost my job right before my paid vacation?

I was recently fired from my job right before my 5 days of paid time off was about to start. Do I still have a right to collect for the pto?|||You should still get paid for your vacation time that accumulated|||Vacation time is usually earned time.......so yes, so long as you've put the time in to earn it.|||Were you fired for a good reason, or laid off due to downsizing, etc. There may be a difference because most companies have policies about laying off people. However, if you were fired, when were the 5 days earned? As soon as you started, or did you have to work there so long before you earned the time. You didn't say how long you had been working. If you worked right up until you were going to get the time off, then it seems you earned that time and should be compensated for it. My sister got into a company that did this, and she fought it, had 2 weeks coming to her, and she got a check for 2 weeks of vacation leave that was unused. Good Luck.|||If you have accrued the PTO over time, it must generally be paid to you upon termination. (The precedent is Suarez v. US Plastics.) However, every PTO plan is different because PTo is granted by the company, not by law. It really depends on how your plan is written, and to some extent, what your state's laws are governing PTO payouts.





Ask for a copy of the company's PTO plan, or review your employee handbook if you still have it. Then check the wage and hour section of www.dol.gov to review wage and hour laws for your state. That will tell you if you're entitled to payment for accrued time.





Good luck!|||You should get paid alright, but what's more important is that you were saved from taking the decision to quit that job. If a company thinks taking out a training manual is against its interests, its staff must know first. It sounds more like someone at your company is obsessed with playing snakes and chutes. Or is there an army veteran whose idea of fun is ambushing innocent employees? I can imagine the glee on their face when someone gets caught 'breaking' the law. Wish you all the best in finding a better job ( maybe you'll tend to be cautious at the next place and check with your boss before you take every other step, and get fired for asking too many questions :D)|||if you get fired no you can not collect you vacation and if it does not say in any papers you could take the book then you cant take it sorry
